Terms of Use

By downloading, installing, or using BrainPingPong ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App.

BrainPingPong is a multi-AI platform that enables users to submit text questions, generate images, create videos, and perform face analysis using multiple third-party AI providers simultaneously. The App connects to the following providers (list not exhaustive and subject to change):

• Chat AI (22 providers, 11 countries): Anthropic (Claude), OpenAI (ChatGPT), Google (Gemini), xAI (Grok), Meta (Llama), DeepSeek, Alibaba (Qwen), Mistral AI, AI21 Labs, Cohere, GigaChat, Moonshot (Kimi), Perplexity (Sonar), Falcon (TII), Nvidia (Nemotron), ByteDance (Seed), Zhipu (GLM), Xiaomi (MiMo), Swiss AI (Apertus), Sarvam, Upstage (Solar), Maritaca AI
• Image AI (17 providers, 7 countries): OpenAI (DALL-E/GPT-Image), Google (Imagen), FLUX, Recraft, Leonardo, HiDream, Playground, Dreamshaper, RunDiffusion (Juggernaut), Luma (Photon), Stability (SDXL), Kolors, Alibaba (Qwen Image), Z-Image, Freepik, xAI (Grok Image), ByteDance (Seedream)
• Video AI (11 providers, 6 countries): ByteDance (Seedance), MiniMax (Hailuo), ShengShu (Vidu), xAI (Grok Video), Runway, PixVerse, Lightricks (LTX), PrunaAI (P-Video), Freepik, VFX

The list of providers, models, and supported features may change at any time without prior notice.

The App is free to download and includes a Free tier consisting of 15 credits. Enhanced features are available through auto-renewing subscriptions:

• BYOK: Free (Bring Your Own Keys, unlimited use)
• Premium: $9.99/month — 1,000 credits/month
• Pro: $19.99/month — 2,200 credits/month
• Ultimate: $99.99/month — 12,000 credits/month
• Unlimited: $199.99/month — Unlimited credits (fair use)

Credits are consumed per AI request. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period in your app store settings.

Users may supply their own API keys from supported AI providers. When using your own keys:

• You are responsible for all costs incurred with those providers
• You must comply with each provider's terms of service
• API keys are stored securely on your device using encrypted storage
• BrainPingPong never transmits your API keys to our servers

You agree not to use the App to:

• Generate illegal, harmful, abusive, or explicitly sexual content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Attempt to circumvent content safety measures
• Harass, defame, or harm others
• Distribute malware or interfere with the App's operation

Generated images and videos are scanned for inappropriate content using Microsoft Azure Content Safety. Content that violates these terms may be blocked automatically.

When you use the App, your input (text, photos, voice, prompts) is sent directly to the third-party AI providers you select. Before any data is shared, the App displays a Data Sharing Disclosure and requires your explicit consent.

• No account or login is required — you remain anonymous
• Photos are never stored on BrainPingPong servers
• AI providers receive requests under the App's credentials, not yours
• API data is typically deleted by providers within 30 days

You acknowledge and agree that:

• We are not responsible for the availability, uptime, or performance of any third-party AI provider.
• We are not responsible for the accuracy, completeness, quality, or reliability of any content generated by AI providers.
• We are not responsible for any failure of an AI provider to generate content or deliver results.
• AI providers may change, discontinue, or modify their models, capabilities, and pricing without notice.
• Face analysis results are statistical estimates only and should not be relied upon for consequential decisions.
• AI-generated content may contain errors, biases, hallucinations, or inappropriate material despite safety measures.
• You must comply with each third-party provider's own terms of service.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

AI-generated content should not be used as the basis for medical, legal, financial, or other consequential decisions. You use all AI outputs at your own risk. We do not guarantee that any specific AI provider will be available at any given time.

To the maximum extent permitted by applicable law, BrainPingPong and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• The use or inability to use the App or any AI provider
• Any content generated by third-party AI providers
• Unavailability or downtime of any AI provider
• Errors, inaccuracies, or omissions in AI-generated content
• Any credits consumed for failed or unsatisfactory AI requests

Credits consumed for AI requests that fail due to provider errors are automatically refunded within the App. Subscription refunds are handled by Apple or Google according to their respective refund policies.

The App is intended for users aged 12 and older. Users under 17 should use the App with parental guidance. Content generated by AI providers may not always be appropriate for all ages despite safety measures.

We reserve the right to modify these Terms at any time. Changes take effect when posted. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
